These Terms & Conditions apply to purchases made from Golden Thistle Memorials and use of the Golden Thistle Memorials website.

Please read them carefully before placing an order.

By placing an order with Golden Thistle Memorials, you agree to these Terms & Conditions.

Nothing in these Terms & Conditions affects your statutory rights as a consumer.

Golden Thistle Memorials is a small independent business based in Scotland, specialising in personalised memorial keepsakes for pets and loved ones.

Throughout these Terms & Conditions, "I", "me" and "my" refer to Golden Thistle Memorials.

"You" and "your" refer to the customer purchasing from or using the Golden Thistle Memorials website.

2. Products

Golden Thistle Memorials offers personalised and made-to-order keepsakes, which may include:

• Memorial photo slates

• Engraved jewellery

• Paw print and nose print jewellery

• Personalised pet tags

• Collar holders

• Hanging decorations

• Personalised jewellery boxes

• Other memorial and remembrance keepsakes

Product availability may change from time to time.

I make reasonable efforts to ensure that product descriptions, photographs, measurements and other information displayed on the website are accurate.

Because many products are individually made, engraved or personalised, minor differences may occur between website photographs and the finished product.

​

Colours may also appear slightly different depending upon screen and device settings.

​

Such variations do not affect your statutory rights where goods are faulty, not as described or otherwise fail to conform to the contract.

3. Placing an Order

When placing an order, you are responsible for ensuring that the information you provide is complete and accurate.

This includes:

• Your name and contact information

• Billing and delivery address

• Product selection

• Photographs

• Paw or nose prints

• Names and dates

• Personal messages

• Engraving instructions

• Any other personalisation requested

After an order has been placed, you will receive confirmation electronically where applicable.

I reserve the right to contact you if further information is required before your order can be produced.

4. Personalised and Made-to-Order Products

Many Golden Thistle Memorials products are created specifically for an individual customer.

​

A personalised order may incorporate photographs, paw prints, nose prints, handwriting, names, dates, messages, custom layouts or other information supplied by you.

​

Because these products are made to your specifications or clearly personalised, the normal statutory right to cancel an online purchase because you have changed your mind may not apply.

​

This does not affect your statutory rights where goods are faulty, damaged, not as described or otherwise do not conform to the contract.

​

5. Customer-Supplied Photographs, Paw Prints and Other Material

You are responsible for ensuring that you are entitled to provide and use any photograph, image, paw print, nose print, handwriting, wording or other material submitted to Golden Thistle Memorials.

​

By supplying material for use in a personalised product, you confirm that:

• You have the necessary right or permission to provide it;

• Its use for your requested keepsake will not knowingly infringe another person's intellectual property or other legal rights; and

• The information and personalisation instructions you provide are accurate to the best of your knowledge.

I reserve the right to decline material that I reasonably believe may be unlawful, offensive or infringe another person's rights.

​

Customer-supplied material remains the property of its respective owner.

​

Providing material for an order does not automatically give Golden Thistle Memorials permission to use it for advertising or promotional purposes.

​

6. Image and Print Quality

The quality of a finished personalised product can depend upon the quality of the photograph, scan, paw print, nose print or other material supplied.

​

Where possible, I will advise you if I believe the quality of supplied material may significantly affect the finished result.

​

However, I cannot create detail that is not present in the original image or print.

​

Where you choose to proceed after being advised of a quality limitation, the resulting characteristics caused by the supplied material will not in themselves constitute a product fault.

​

This does not affect your statutory rights.

​

7. Digital Proofs

Where applicable, a digital proof or visual design will be sent to you before the personalised keepsake is completed.

​

The purpose of the proof is to allow you to check the design before production.

​

You are responsible for carefully checking:

• Names

• Dates

• Spelling

• Photographs

• Paw or nose prints

• Personal messages

• Engraving

• Layout

• Positioning

• Any other requested personalisation

​

Please notify me of any changes required before approving your proof.

​

8. Approval of Your Proof

Production will begin once you have approved the final proof.

​

By approving the proof, you confirm that you are satisfied with the personalisation and information shown.

​

If the finished product accurately reproduces the approved proof, I will not normally be able to provide a free replacement or refund because an error that was visible in the approved proof is subsequently noticed.

​

For example, this could include an incorrect spelling, name, date, message or photograph selected or approved by the customer.

​

If Golden Thistle Memorials makes an error and your finished item does not correspond with the approved proof or agreed specification, please contact me and I will take appropriate steps to put this right.

​

Nothing in this section limits your statutory consumer rights.

​

9. Changes After Proof Approval

Once a final proof has been approved, production may begin immediately.

​

It may therefore not be possible to make further changes or cancel the personalised item.

​

If you contact me quickly enough and production has not begun, I will make reasonable efforts to accommodate your request.

​

Where additional work or materials are required because you request a change after approval, an additional charge may apply. Any additional charge will be explained and agreed before the additional work is undertaken.

​

10. Prices and Payment

Prices are displayed in pounds sterling (£) unless otherwise stated.

​

The price payable will be the price displayed and agreed when you place your order, together with any applicable delivery charges and optional extras.

​

Any additional charge will be clearly communicated before you agree to it.

​

Payment must be made using one of the payment methods available through the website or otherwise agreed with Golden Thistle Memorials.

​

Your order will not normally enter production until the required payment has been received.

​

11. Jewellery Box Engraving

Where available, a personalised message may be engraved onto a jewellery presentation box for an additional £5.

​

The amount of wording that can be engraved may depend upon the size and design of the box.

​

If wording is unsuitable because of available space or technical limitations, I will contact you to discuss an appropriate alternative.

​

Please carefully check any jewellery-box wording included in your proof before approval.

​

12. Production Times

Production times vary depending upon the product.

​

Memorial Photo Slates - These can normally be completed within approximately 3 business days following approval of the final proof.

​

Jewellery and Other Made-to-Order Keepsakes

Please normally allow approximately 1–2 weeks following approval of the final proof.

​

Some jewellery or other materials may need to be ordered specifically for your keepsake.

​

Production times are estimates unless a specific completion or delivery date has been expressly agreed.

​

Production time and postal delivery time are separate.

​

If an unexpected significant delay occurs, I will contact you as soon as reasonably possible.

​

13. Delivery

Delivery options, charges and relevant estimated delivery times are explained on the website and in the Golden Thistle Memorials Shipping, Cancellations & Returns Policy.

​

You are responsible for providing an accurate and complete delivery address.

​

Please contact me as soon as possible if you discover an error in your delivery details.

​

Once an order has been dispatched, it may not be possible to change the delivery address.

​

14. Cancellation and Returns

Your cancellation and return rights depend upon the type of product purchased.

​

Many Golden Thistle Memorials products are made to your specifications or clearly personalised. These products may be exempt from the usual change-of-mind cancellation rights that apply to some distance purchases.

Different provisions apply to eligible non-personalised goods.

​

Nothing in these Terms & Conditions affects your statutory consumer rights.

15. Faulty, Damaged or Incorrect Goods

Goods supplied by Golden Thistle Memorials must meet the standards required by applicable UK consumer law.

Please provide your order information and, where possible, photographs showing the issue so that I can investigate promptly.

​

Depending upon the circumstances and your statutory rights, an appropriate remedy may include repair, replacement, price reduction or refund.

Your rights under the Consumer Rights Act 2015 and other applicable consumer legislation are not restricted by these Terms & Conditions.

16. Handmade and Personalised Characteristics

Many Golden Thistle Memorials keepsakes are individually created rather than mass-produced.

​

Small variations in positioning, natural materials, engraving appearance or finish may occasionally occur as part of the production process.

​

These minor variations are not necessarily defects.

​

However, this clause does not exclude your rights where a product is faulty, materially different from its description or approved design, or otherwise fails to meet applicable legal standards.

​

17. Intellectual Property

Unless otherwise stated, the Golden Thistle Memorials website and original materials created for the business, including branding, logos, website copy, graphics and original product designs, are owned by or licensed to Golden Thistle Memorials and are protected by applicable intellectual property law.

​

They may not be copied, reproduced, distributed or commercially exploited without permission except where permitted by law.

​

Customer-supplied photographs, artwork and other material remain subject to the rights of their respective owners.

​

Purchasing a product does not transfer ownership of Golden Thistle Memorials' intellectual property rights in an original design.

​

18. Promotional Use of Customer Orders

I may occasionally wish to photograph or display finished keepsakes as examples of my work.

​

Where an item contains identifiable personal photographs, names, paw prints, messages or other personal information, I will only use it for promotional purposes where I have an appropriate lawful basis to do so, including obtaining permission where required.

​

Declining promotional use will not affect your order.

​

19. Website Use

The information provided on the Golden Thistle Memorials website is intended to help customers understand the products and services available.

Website content may occasionally be updated or changed.

You must not knowingly:

• Misuse the website;

• Attempt to gain unauthorised access to the website or associated systems;

Occasionally, circumstances outside my reasonable control may affect production or delivery.

Examples may include severe weather, postal disruption, supplier delays, illness, transport disruption or other unforeseen events.

Where this materially affects your order, I will contact you as soon as reasonably possible and take reasonable steps to minimise the impact.

Your statutory rights remain unaffected.
